How To Deal With Modern Day Persecution

 

These days the powers that be no longer burn offenders at the stake, but they certainly do still persecute innocent people. The tall black hat of the Witchfinder General Mathew Hopkins has been replaced by the tall yellow camera at the side of the road. Same job though,  finding those that have sold their souls to the devil i.e. motorists. Now I, like most of you perhaps, do not consider myself to be a criminal. But there exists today a twisted system that is creating a new persecuted class of which I, and maybe 50% of the adult population, may soon belong.  Don’t believe me? Last year 3.5 million motorists were criminalized by the police, fined for speeding, victims of the Witchfinder Government. There is no way out but to accept and pay a fine when sent a Notice of Intended Prosecution for speeding having been snapped by a police camera, you may think. But think again I say. Why be a push over for the boys in blue when you could defy them and escape the modern day persecutors?

 

In Lancashire and also in many other counties the Police have decided to adopt a policy of zero tolerance with regard to the enforcement of speed limits. Many roads are now ‘policed’ by ‘speed-cameras’ that take photographs of vehicles and their registration numbers. Exceeding the speed limit on any given road by as little as 1 mph may result in the registered owner of the offending vehicle being issued with a Notice of Intended Prosecution or NIP. The owner is, according to this notice, required to inform the Police who was driving the offending vehicle or, under section 172 of The Road Traffic Act 1988, face prosecution for failing to comply. In other words the owner of the vehicle is presumed to be a suspect and their right of silence i.e. the right to say nothing that may incriminate them is removed by section 172 of the Road Traffic Act.

 

Now if I were to break an entry into your home, strangle your cat, do an Ozzy Osbourne on the budgie and murder your great aunt with a kitchen knife, then I would, once apprehended, be cautioned by the police under PACE the Police and Criminal Evidence Act.  ‘You do not need to say anything, but anything that you do say may be taken down and used in evidence against you’ or words to that effect. However, if a car or other vehicle that is registered to me is captured on a ‘speed-camera’ exceeding the speed limit then my right to silence is removed and I am, according to section 172 of the RTA 1988, required to utter or face a penalty that is at least as onerous as that which would pertain had I been actually driving said vehicle at the time that it exceeded the speed limit. In other words there is a clear presumption made by those prosecuting that the registered owner is guilty and extreme duress is applied by the issuing of a Notice Of Intended Prosecution which states that one would commit an offence if one did not complete the form they attach and name said driver. Now this is surely entrapment. It is also a breach of the basic human rights of all British and indeed European people as enshrined in Section 6 of the European Convention of 1951 to which Great Britain is a signatory. Not only that it is a breach of PACE, as no caution is given before you are intimidated into confessing.

 

Some believe that constitutions exist to protect the State against the people but their proper purpose is to protect the people from the potential tyranny of the State. It was for this reason that Magna Carta was signed by King John in 1215, not to give us rights, but to recognise that they are inherent and may not be removed.

 

Winston Churchill wrote in 1956 in "A History of the English Speaking Peoples"

"The facts embodied in Magna Carta and the circumstances giving rise to them were buried or misunderstood. The underlying idea of the sovereignty of the law, long existent in feudal custom, was raised by it into a doctrine for the national State. And when in subsequent ages the State, swollen with its own authority, has attempted to ride roughshod over the rights or liberties of the subject it is to this doctrine that appeal has again and again been made, and never as yet, without success."

The problem with the Government, as represented by the police, prosecuting people by use of duress is that it amounts to an act of intimidation. As I said at the start of this column, I do not consider myself to be a criminal. I will also not permit myself to become a criminal just because the Government think they can abolish my human rights and require me to make a statement under the threat of a penalty. Such practices were used in the 16th and 17th centuries by the likes of The Witchfinder General Mathew Hopkins who tortured so-called witches making them confess to all manner of ridiculous nonsense rather than face the ordeals he offered. Today the police are attempting something similar with their Notices Of Intended Prosecution i.e. confess or face a fine and penalty points anyway making criminals of those they persecute. Today we may be guilty until we prove our innocence and that is an abuse of authority.

 

The truth is that when we are all criminals there are no criminals. Turning someone that considers that they are innocent into a criminal alienates them. Thus the very spirit of national brotherhood is being systematically eroded by the Government who are allowing and encouraging the police to prosecute basically innocent car owners for no reason other than to raise cash via fines for what they term ‘speeding offences’. There are verifiable statistics that clearly show that deaths on the road caused by motorists have increased since the police virtually abandoned patrols and came to rely upon the ‘speed-cameras’.  One may argue otherwise but it is a fact that one strategically placed ‘speed-camera’ can ‘earn’ over a million pounds a year from fines, that is money extracted by duress and intimidation from motorists. If you travel the roads take a careful look at where these ‘speed cameras’ are placed and you will see that many are located not where there is potential danger to the public but where the motorist is likely, due to road conditions i.e. halfway down a hill, to be above the limit. Is that done to make our roads safe?  No it isn’t, it is done to entrap motorists who are subsequently coerced by receiving an NIP in the post to cough up money and the authorities then pocket their cash. If you let them get away with it that is what they will do and maybe more, BUT ONLY IF YOU LET THEM!

 

What has all this to do with those that are not motorists and have not signed a pact in blood with the DVLA, they can’t even spell devil these days. You may well ask. I believe that our spirits, our inner spirits, our life forces are being subdued by the state/government abusing its people. We are not slaves, we are not controlled by machines such as ‘speed-cameras’. Nor should we permit ourselves to be intimidated by misguided, authoritarian, officials into abandoning our right to silence. I therefore respectfully suggest that if you do get a Notice Of Intended Prosecution from the police re a speeding offence you send it back blank with a letter saying that Section 172 of The Road Traffic Act breaches Section 6 of the European Convention 1951 signed by The British Government in 1953 which supersedes the authority of Section 172 RTA 1988.   It is up to you to defy The Witchfinder Government and protect your human rights. Take legal advice first though, just like David Beckham did.  If you feel really strongly about this matter why not post this article to your local MP saying that you fully agree. Or just accept the abuse then watch as we all become criminals and alienated enemies of the State.
